Are any employers being challenged on the practice of expecting employees to be available via cell/email during off hours?

If you don't take work calls/email on the weekend, you run the risk of being characterized as a slacker. If you do, you're working for free at the expense of your personal and family time. If there is not an organized effort to address this issue, there should be.

I am outraged about the practice but I don't think you can legally prevent it, particularly in the current environment. I am not even sure that you should be able to ban it and I'm generally a real leftie. Sometimes it is a necessity but OTOH, virtually every employer will abuse the privilege. Requiring compensation will only make the abuse worse.

This practice would seem to be a great way to discourage initiative and competence in employees.
