Any international law gurus here?

The question: Would Kissinger, indeed, be indictable under the precepts of the Geneva Convention?
What loopholes, if any, can be incorporated here? (cont'd)

What is your definition of 'war criminal'? By your argument about Kissinger, do you think Calley was not a war criminal? Princeton says all it takes is violation of international law to be a war criminal.

I've only had one seminar in public international law, and its focus was the Bush administration. Why don't you visit your law library? The librarian can help you locate appropriate sources.

but keeping the question broader to "who is a war criminal?"
would be much more a discussion on SP...

For my Cold War History class, a number of us have been chosen to compete in a final in class debate. The winners will receive an automatic "A" for the seminar portion of the class, and will not have to right the final exam.
I am highly motivated, but it appears I've hit a brick wall as far as an argument goes.
The debate - "Is Henry Kissinger a War Criminal"
Our side was picked to play devil's advocate.
My guess is that much of the other team will be drawing from Hitchens. Much of the arguments in this book, while damning, are ideological rather than judicial - evidence is prima facie, but again, it's pretty weighted in their favor rather than us. Especially in a classroom filled with "New Left" kids. Much of the judicial argument rests on the Alien Tort clause, which I admittedly have little knowledge of.
The only fireproof(ish) arguments we have are that as he wasn't "commander in cheif", he lacked the agency to be considered a war criminal. Causality is very difficult to establish - others (namely, Ford and Nixon) would need to be prosecuted first. Other arguments are that Hitchen's completely removes Kissinger from the context in which the American foreign policy machine operated - the book is largely devoid of any discussion of Cold War dynamics which would, qualitatively, legitimize actions in the name of realpolitik.
